Offshore Courts provides a 3-year limited warranty on all courts. Pumps included with your purchase carry a 90-day limited warranty period. The specific terms and conditions below govern warranty coverage, limitations, and exclusions.
Offshore Courts Warranty Policy
1. Limited Warranty Coverage
Offshore Courts warrants its products to be free from defects in materials and workmanship under normal use for a period specified at the time of purchase. Warranty coverage begins on the date the product is delivered to the customer. Proof of purchase is required for all warranty claims.
2. Warranty Exclusions
This warranty does not cover damages resulting from:
- Misuse, abuse, or negligence
- Unauthorized modifications or repairs
- Accidents, natural disasters, or acts of God
- Failure to follow product instructions or maintenance guidelines
Custom-designed products are provided ‘as-is’ and are not eligible for warranty coverage unless explicitly stated otherwise in writing.
3. Limitation of Liability
NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, IN NO EVENT SHALL OFFSHORE COURTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR BUSINESS INTERRUPTION, EVEN IF OFFSHORE COURTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE MAXIMUM LIABILITY OF OFFSHORE COURTS UNDER THIS WARRANTY SHALL BE LIMITED TO THE PURCHASE PRICE PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
4. Indemnification
The customer agrees to indemnify, defend, and hold harmless Offshore Courts, its officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of the use, ownership, or operation of the products, except to the extent caused by the gross negligence or willful misconduct of Offshore Courts.
5. Intellectual Property Ownership
All intellectual property rights in the products, website, and related materials, including but not limited to copyrights, trademarks, trade dress, and trade secrets, remain the sole property of Offshore Courts or its licensors. No rights or licenses are granted to the customer except as expressly provided herein.
6. Trademarks
The Offshore Courts name, logo, and related marks are trademarks of Offshore Courts and may not be used without prior written permission.
7. Use by Children
The Offshore Courts website and products are intended for use by individuals aged 13 or older. Users under the age of 13 must use the site under the supervision of a parent or guardian.
8. Payment Methods
Standard payment terms require a 50% deposit on custom orders, with the balance due prior to shipping. All duties, taxes, and shipping charges are the responsibility of the purchaser. Acceptable payment methods include wire transfer and major credit cards, with a convenience fee applied to credit card payments as specified at the time of purchase.
9. Choice of Law & Arbitration
This warranty and any disputes arising from it shall be governed by the laws of the Province of Ontario and applicable Canadian federal law. Any disputes shall be resolved by binding arbitration in Toronto, Ontario, under the rules of the ADR Institute of Canada. Customers waive any right to participate in class actions or representative proceedings.
10. Warranty Claims Process
To make a warranty claim, customers must contact Offshore Courts at the address or email provided on the company website. Warranty claims must include proof of purchase and a detailed description of the defect. Offshore Courts reserves the right to repair or replace defective products at its discretion.
